"Content" means all text, graphics, images, software, data and other material available on the Platform. "Services" means the property, facility, community, lead-management, booking, payment and related digital services made available through the Platform. "Account" means a registered user profile created on the Platform.
You must be at least 18 years of age and competent to enter into a contract under the Indian Contract Act, 1872 to use the Platform. By using the Platform, you represent and warrant that you meet these requirements and that all information you provide is true, accurate, current and complete.
Certain features require you to create an Account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account. You agree to notify us immediately of any unauthorised use of your Account. We reserve the right to suspend or terminate Accounts that contain false information or that are used in violation of these Terms.

The Platform may enable you to register interest (including Expression of Interest / EOI), schedule site visits, make bookings, purchase products or services, and make related payments. All such transactions are subject to the specific terms, descriptions, pricing and availability displayed at the time of the transaction. We reserve the right to accept or decline any request or transaction at our discretion. Payments are governed by our Payment Policy.
Prices for products and services are displayed on the Platform and are subject to change without prior notice. All payments are processed through third-party payment gateways, namely Easebuzz and CCAvenue. By making a payment, you agree to the terms of our Payment Policy and the terms of the applicable payment gateway. Applicable taxes and charges will be levied as per prevailing law.
Cancellations and refunds, where applicable, are governed by our Payment Policy and by the specific terms communicated at the time of the transaction. Approved refunds are ordinarily processed within 15 to 20 days. Certain amounts, including expressions of interest and booking amounts, may be non-refundable in whole or in part where so stated at the time of payment.
All Content on the Platform, including the design, layout, trademarks, logos, software and underlying technology, is owned by or licensed to Samshik and is protected by applicable intellectual property laws. Except as expressly permitted, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display or exploit any Content without our prior written consent.
You retain ownership of content you lawfully submit to the Platform but grant Samshik a non-exclusive, royalty-free, worldwide licence to use, host, store, reproduce and display such content to the extent necessary to operate and provide the Services. You represent that you have all necessary rights to the content you submit and that it does not violate any law or third-party right.
The Platform may contain links to, or integrations with, third-party websites and services (including payment gateways). We do not control and are not responsible for the content, policies or practices of any third party. Your use of any third-party service is governed by that third party's own terms and policies.
The Platform and Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted availability. We do not warrant that the Platform will be error-free, secure or free from viruses or other harmful components.
To the maximum extent permitted by law, Samshik, its directors, employees and affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising out of or in connection with your use of, or inability to use, the Platform. In no event shall our aggregate liability exceed the amount paid by you, if any, for the specific transaction giving rise to the claim.
You agree to indemnify, defend and hold harmless Samshik and its directors, employees and affiliates from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in connection with your use of the Platform, your violation of these Terms, or your violation of any law or third-party right.
We may, at our sole discretion and without prior notice, suspend or terminate your access to the Platform, in whole or in part, if we believe you have violated these Terms or any applicable law, or if required to protect the Platform, other users or the public. Upon termination, the provisions of these Terms that by their nature should survive will continue to apply.
These Terms shall be governed by and construed in accordance with the laws of India. Subject to any applicable dispute resolution provisions, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Platform.
We may revise these Terms from time to time. Any changes will be effective upon being posted on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

Personal Information: When you register, make an enquiry, express interest (EOI), schedule a site visit, make a booking or transact on the Platform, we may collect your name, email address, postal address, telephone/mobile number, and other identifying details you choose to provide.
Transaction and Payment Information: When you make a payment, transaction details such as the amount, date, order reference and payment status are collected. Payments are processed by our third-party payment gateways, Easebuzz and CCAvenue. We do not collect or store your complete card number, CVV, PIN, net-banking password or UPI PIN; such sensitive payment credentials are handled directly by the payment gateway in accordance with its own security standards.
Non-Personal and Technical Information: We may automatically collect information that does not directly identify you, such as browser type and settings, device information and operating system, IP address, date and time of access, pages viewed, referring URLs, and usage patterns. All online payments on the Platform are processed through PCI-DSS compliant third-party payment gateways, namely Easebuzz and CCAvenue. We do not store your complete card number, CVV, PIN, net-banking password, UPI PIN or any other sensitive authentication credentials on our servers. Such information is collected and processed directly by the respective payment gateway in accordance with its own terms and security standards.

All transactions on the Platform are processed in Indian Rupees (INR) unless expressly stated otherwise. Where a payment is attempted in a foreign currency, conversion charges, cross-border fees and exchange rates levied by your bank or card issuer shall apply and are solely your responsibility.
The amount payable for any product, service, booking, membership, expression of interest (EOI), or other offering will be displayed on the Platform before you confirm the payment. All applicable taxes, including Goods and Services Tax (GST), convenience charges and statutory levies, will be charged as per prevailing law and, where applicable, shown separately at the time of checkout. Prices are subject to change without prior notice; however, any change will not affect orders for which payment has already been successfully completed.
By submitting payment details, you represent and warrant that you are authorised to use the payment instrument and that the information provided is true, accurate and complete. A transaction is considered successful only when we receive a confirmation of payment from the payment gateway. On successful payment, an electronic acknowledgement / receipt will be generated and, where applicable, sent to your registered email address or mobile number.
In the event that an amount is debited from your account but the transaction is not confirmed as successful, or a transaction remains in a pending state, please contact us with the transaction reference details. Such cases are typically auto-reconciled by the payment gateway and the bank. If a payment has been debited without a corresponding successful order, the amount is generally reversed by the bank within 7 to 10 business days, as per the policies of the issuing bank and the payment gateway. Samshik is not responsible for delays attributable to the bank or the payment gateway, but will provide reasonable assistance in tracing such transactions.
Refunds, where applicable and approved in accordance with the relevant product or service terms, will be processed to the original payment method used for the transaction. Approved refunds are ordinarily processed within 15 to 20 days from the date of approval. The actual time for the amount to reflect in your account may additionally depend on your bank or card issuer. Convenience fees, payment-gateway charges and any non-refundable components (where expressly stated at the time of payment) may be deducted from the refund amount.
Expression of Interest (EOI), booking amounts, and similar pre-payments are governed by the specific terms communicated to you at the time of the transaction; certain such amounts may be non-refundable or refundable only in part. Please review the applicable terms before making such a payment.
If you have any concern regarding a charge, please first contact us so that we may attempt to resolve the matter. Initiating a chargeback without contacting us may delay resolution. We reserve the right to contest any chargeback that we believe to be invalid, and to suspend or restrict access to the Platform pending resolution of a payment dispute.
We employ reasonable technical and organisational measures, and rely on the security infrastructure of our payment gateway partners, to protect payment information. However, no method of electronic transmission or storage is completely secure, and you transmit information at your own risk. You are responsible for maintaining the confidentiality of your account credentials and payment instruments.
We may amend this Payment Policy at any time. Any changes will be effective upon being posted on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the revised Policy.
